Terms of Service
1. The service
SMBSoft is cloud business-management software for Québec small and medium businesses: accounting, invoicing with GST/QST, online payments, Québec payroll, project and job-site management, inventory, banking and financial reports. The service is offered by subscription as described on the home page.
2. Account and access
- You are responsible for keeping your credentials confidential and for activity under your account.
- Team member access is under your control: you assign roles (owner, administrator, accountant, employee) and may revoke them at any time.
- You must provide accurate information when opening the account and keep it up to date.
3. Subscription, trial and billing
- Each plan is billed monthly, in advance, at the current pricing shown on the site. Prices are in Canadian dollars, taxes extra.
- The trial period is free and without commitment; a paid subscription is required to keep using the service afterwards.
- You may cancel at any time; cancellation takes effect at the end of the period already paid. No prorated refunds are issued for a started month.
- We may change pricing with at least 30 days' notice by email or in-app notice.
4. Your data
- Your data belongs to you. The accounting data, invoices, contacts, employees and documents you store in SMBSoft remain your property.
- You can export your data (reports, entries, files) at any time during your subscription.
- After an account is closed, data is kept for 90 days (to allow reactivation or a final export) and then deleted from our active systems, subject to legal retention obligations.
- Personal information handling is described in our privacy policy.
5. Acceptable use
You may not use the service for illegal activities, attempt to access other customers' data, probe or compromise the platform's security, resell access without a written agreement, or upload malicious content. We may suspend an account that breaches these rules, with notice where reasonably possible.
6. A tool — not an advisor
SMBSoft is a calculation and bookkeeping tool. It does not replace the advice of a professional accountant (CPA), tax specialist or lawyer. Tax and payroll calculations are based on parameters published by tax authorities; you are responsible for validating your filings before submitting them. Some features (e.g. tax slip transmission) may require registrations with the CRA or Revenu Québec.
7. Availability and support
We aim for continuous availability without guaranteeing it. Planned maintenance or unplanned interruptions may occur. Data is backed up daily. During beta, some features are clearly identified as such and may change.
8. Limitation of liability
To the extent permitted by law, SMBSoft's total liability for any damage related to the service is limited to the subscription fees paid in the 12 months preceding the event. SMBSoft is not liable for indirect damages (loss of profits, customers, or data caused by non-compliant use). Nothing in these terms limits rights that cannot be limited under the laws of Québec.
9. Changes
We may amend these terms; material changes are announced at least 30 days in advance by email or in the application. Using the service after they take effect constitutes acceptance.
10. Governing law
These terms are governed by the laws of Québec and the laws of Canada applicable therein. Any dispute falls under the jurisdiction of Québec courts.
